General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions (GTC) govern the use of the apps "Music Logger" and "Music Hunter" (hereinafter referred to as "Apps") by consumers. The provider of the Apps is:

Deviating terms and conditions of the user shall not apply.
2. Description of Services
(1) Music Logger is an app for the automated recognition and logging of music played at events, parties, or comparable occasions (focused on DJs). (2) Music Hunter is an app for the passive background recognition of music in daily life (focused on listeners).
(3) Both Apps capture the following information: * Recognized song title * Recognized artist (author) * Time of playback * Location or event reference (if provided by user)
(4) The following are NOT captured or stored: * Conversations or voice recordings * Voices of individuals * Other audio content outside of music * Personal data of guests or third parties
(4) The App serves specifically for the documentation of played music and the avoidance of song duplications.
(5) Music recognition is performed automatically via external music recognition interfaces, primarily utilizing Shazam (Apple) technology. Integrated playback functionalities are provided via Spotify.
(6) The average recognition accuracy of the App is approx. 80%. A complete or error-free recognition of all played songs is technically not possible.
(7) The functionality of the App is particularly restricted or excluded if: * unreleased songs or songs not recorded in databases are played, * songs are heavily altered in their speed, pitch, or structure, * there is no stable internet connection, * the audio quality at the recording location is insufficient.
3. Activation and Consent
(1) Music recognition occurs exclusively following active usage by the user. Recording does not take place without the user's knowledge.
(2) By using the App, the user confirms that they are authorized to perform music recognition at the respective location and that no third-party rights are being infringed.
4. Registration and User Account
(1) Use of the App requires the creation of a user account. (2) The user is obligated to provide truthful information during registration and to keep access data confidential.
5. Cost Model
(1) Music Logger is offered in a free basic version as well as in paid subscription models. (2) Prices, terms, and cancellation conditions of the subscriptions are displayed transparently prior to the conclusion of the contract.
6. Display and Export of Logs
(1) Users can view their recorded music logs within the App and export them in suitable file formats. (2) Responsibility for the further use or publication of exported data lies exclusively with the user.
7. User Obligations
(1) The App must not be used for the surveillance of persons, secret recording in private spaces, or illegal purposes. (2) The user ensures that usage does not violate applicable laws, domiciliary rights (house rules), or contractual obligations.
8. Liability and Warranty
(1) No guarantee is assumed for the completeness or correctness of the music recognition. (2) The provider is not liable for incorrect song recognitions or technical failures. (3) The provider assumes no responsibility for GEMA, licensing, or copyright obligations of the users. (4) The provider is not liable for restrictions resulting from the use of external services (e.g., Shazam API, Spotify API) or lack of internet connection.
9. Availability
The provider strives for high availability but owes no uninterrupted use.
10. Data Protection
Information regarding the processing of personal data is regulated in the separate Privacy Policy.
11. Termination of Contract
(1) Users may terminate their account at any time. (2) The provider may terminate the contract in the event of serious violations of these GTC.
12. Regional Availability
(1) The App is generally available worldwide. (2) Exclusion: The use of the App is currently not available and not supported in the following regions: Brazil, South Korea, and Japan. Users in these regions are excluded from the service due to regional regulatory requirements.
13. Final Provisions
(1) German law applies. (2) Should individual provisions be invalid, the remaining regulations remain unaffected. (3) The place of jurisdiction is—to the extent legally permissible—Aachen, Germany.
